Terms of Service

Effective from 1 April 2026

These Terms of Service (“Terms”) set out the terms and conditions on which Dr Anna Brogden, trading as Chemistry Distilled, provides private online chemistry tuition services. By purchasing sessions or session packs, or by booking or attending a session, the Client agrees to be bound by these Terms.

1. Definitions and Interpretation

  1. 1.1 In these Terms, unless the context otherwise requires, the following expressions have the following meanings:
“Tutor” Dr Anna Brogden, trading as Chemistry Distilled.
“Client” The parent, guardian, or adult student who purchases sessions or session packs from the Tutor and enters into the contract governed by these Terms.
“Student” The individual who receives tuition during a Session, whether the Client themselves or a child or young person for whom the Client is responsible.
“Session” A single one-hour (60-minute) online tuition lesson delivered by the Tutor to the Student via video call.
“Pack” A pre-purchased bundle of Sessions offered at a discounted rate (for example, 5, 10, or 20 Sessions, or an Oxbridge Preparation pack).
“Platform” The Chemistry Distilled website at chemistrydistilled.com.
“Booking System” The Calendly scheduling platform used by Chemistry Distilled to manage session bookings.
“Payment Processor” Stripe, the third-party payment processing service used by Chemistry Distilled to process payments made through the Platform.
  1. 1.2 References to the “Tutor” include her employees, agents, and authorised representatives, where the context so requires.
  2. 1.3 Headings are for convenience only and shall not affect the interpretation of these Terms.
  3. 1.4 Words in the singular include the plural and vice versa, and references to one gender include all genders.

2. Services

  1. 2.1 The Tutor provides one-to-one private online chemistry tuition delivered via video call.
  2. 2.2 Tuition is offered at the following levels: GCSE, A-Level, and Oxbridge Preparation (including interview preparation and admissions test support).
  3. 2.3 Each Session is 60 minutes in duration.
  4. 2.4 The Tutor shall determine the appropriate teaching methods, materials, and lesson content at her sole discretion, taking into account the Student’s level, needs, and learning objectives as communicated by the Client and the Student.
  5. 2.5 The Tutor does not provide an examination or assessment service. Any practice questions, mock tests, or assessments provided during Sessions are for educational purposes only and do not constitute formal assessment.

3. Booking and Scheduling

  1. 3.1 All Sessions must be booked through the Booking System (Calendly). The Tutor is not obliged to honour bookings made by any other means.
  2. 3.2 A minimum of twenty-four (24) hours’ notice is required when booking a Session. The Booking System will not permit bookings with less than twenty-four hours’ notice.
  3. 3.3 Sessions are subject to the Tutor’s availability as displayed in the Booking System at the time of booking. The Tutor makes no guarantee that any particular date or time will be available.
  4. 3.4 Sessions may only be booked once payment has been completed in accordance with clause 4.

4. Payment Terms

  1. 4.1 All payments for Sessions and Packs are made in advance through the Platform via the Payment Processor (Stripe).
  2. 4.2 Prices for Sessions and Packs are as listed on the Platform at the time of purchase. All prices are stated in pounds sterling (GBP) and are inclusive of VAT where applicable.
  3. 4.3 Payment must be completed in full before any Sessions may be booked. The contract between the Tutor and the Client is formed at the point at which payment is successfully processed.
  4. 4.4 The Tutor reserves the right to change prices at any time. Any change in price shall not affect Packs already purchased; such Packs shall remain subject to the price paid at the time of purchase.
  5. 4.5 The Client is responsible for ensuring that payment details provided to the Payment Processor are accurate and that sufficient funds are available. The Tutor is not responsible for any charges, fees, or penalties imposed by the Client’s bank or payment provider.

5. Cancellation Policy

  1. 5.1 The Client may cancel or reschedule a booked Session at no charge provided that at least twenty-four (24) hours’ notice is given before the scheduled start time. Cancellations and rescheduling must be made via the confirmation email sent by the Booking System (Calendly).
  2. 5.2 If the Client cancels or reschedules a Session with less than twenty-four (24) hours’ notice, or if the Student fails to attend a booked Session (“no-show”), the Session shall be forfeited from the Client’s Pack. The Session will count as used and no refund or replacement Session will be provided.
  3. 5.3 If the Tutor cancels a Session for any reason, the Session will be restored to the Client’s Pack at no cost to the Client, and the Client may rebook the Session at their convenience via the Booking System.

6. Refund Policy

Single Sessions

  1. 6.1 Single Sessions are non-refundable once the Session has taken place.

Session Packs

  1. 6.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Client has the right to cancel a Pack purchase within fourteen (14) days of the date of purchase (the “cooling-off period”) and receive a full refund, unless the Client has expressly requested that the provision of services begin during the cooling-off period.
  2. 6.3 By booking and attending a Session within the cooling-off period, the Client acknowledges and agrees that they have requested early performance of the services. The Client’s right to cancel under the cooling-off period is lost in respect of any Sessions already delivered.
  3. 6.4 Where the Client has requested early performance and subsequently cancels the Pack within the fourteen (14) day cooling-off period, the Client is entitled to a proportionate refund for Sessions not yet delivered. The amount to be deducted for each Session already delivered shall be calculated at the standard single-session rate of £150 per Session, regardless of the discounted rate at which the Pack was purchased.
  4. 6.5 After the expiry of the fourteen (14) day cooling-off period, Packs are non-refundable. Unused Sessions within a Pack are not refundable and may not be transferred to any other person.
  5. 6.6 All Packs are valid for a period of twelve (12) months from the date of purchase. Any Sessions remaining unused at the expiry of this twelve-month period shall lapse automatically and no refund will be provided in respect of such unused Sessions.

Refund Requests

  1. 6.7 All refund requests must be made in writing by email to anna@chemistrydistilled.com. The Tutor will endeavour to process valid refund requests within fourteen (14) days of receipt.

7. Student Lateness and Session Duration

  1. 7.1 Sessions begin at the scheduled start time regardless of the Student’s arrival. If the Student joins the Session late, the Session will not be extended beyond the originally scheduled end time.
  2. 7.2 If the Student has not joined the Session within fifteen (15) minutes of the scheduled start time, the Session shall be treated as a no-show and will be forfeited in accordance with clause 5.2.
  3. 7.3 The Tutor will make reasonable efforts to begin all Sessions on time. If the Tutor is late to a Session, the Session will be extended by the equivalent period of lateness or, where this is not practicable, the Session will be restored to the Client’s Pack at no cost to the Client.

8. Tutor Cancellation and Absence

  1. 8.1 The Tutor may occasionally need to cancel or reschedule Sessions due to illness, personal emergency, or other unavoidable circumstances.
  2. 8.2 In such cases, the Tutor will provide as much notice as is reasonably practicable. The affected Session will be restored to the Client’s Pack at no cost, and the Client may rebook the Session via the Booking System at their convenience.
  3. 8.3 The Tutor shall not be liable for any indirect, consequential, or special losses arising from the cancellation or rescheduling of a Session, including but not limited to travel costs, childcare arrangements, or lost study time.

9. Safeguarding and Child Protection

  1. 9.1 Chemistry Distilled is committed to the safeguarding and welfare of children and young people.
  2. 9.2 Where the Student is under the age of eighteen (18), Sessions are conducted via video call. A parent or guardian must be aware that the Session is taking place and must be available within the household for the duration of the Session, although they need not be present in the room.
  3. 9.3 All Sessions are conducted on a one-to-one basis between the Tutor and the Student. Sessions are not recorded by the Tutor unless expressly agreed in writing with the Client in advance.
  4. 9.4 If the Tutor has any concerns regarding the safety or welfare of a Student, she will follow relevant safeguarding guidance and may contact the appropriate statutory authorities. The Tutor is not required to notify the Client before making such a referral where doing so would be contrary to the interests of the child.
  5. 9.5 The Client is responsible for ensuring that the Student participates in Sessions from a suitable, safe, and appropriate environment.

10. Intellectual Property

  1. 10.1 All teaching materials, worksheets, notes, presentations, diagrams, and other resources created or provided by the Tutor (“Materials”) remain the intellectual property of Chemistry Distilled and/or Dr Anna Brogden.
  2. 10.2 The Client and the Student are granted a personal, non-exclusive, non-transferable, revocable licence to use the Materials solely for the Student’s own private educational purposes. This licence does not confer any ownership rights.
  3. 10.3 The Materials may not be copied, reproduced, distributed, shared with third parties, uploaded to the internet or any online platform, or used for any commercial purpose without the prior written consent of the Tutor.
  4. 10.4 Lesson content published on the Platform as free educational resources is provided for personal, non-commercial educational use only and may not be reproduced, redistributed, or adapted without the prior written consent of the Tutor.
  5. 10.5 Any breach of this clause 10 shall entitle the Tutor to revoke the licence granted under clause 10.2 with immediate effect and to take such further action as she considers appropriate, including seeking injunctive relief.

11. Student Code of Conduct

  1. 11.1 The Student is expected to behave respectfully, courteously, and appropriately during all Sessions.
  2. 11.2 The Tutor reserves the right to terminate a Session immediately if the Student’s behaviour is disruptive, abusive, threatening, discriminatory, or otherwise inappropriate. In such cases, the Session shall be forfeited and shall count as used.
  3. 11.3 Persistent or serious misconduct may result in the immediate termination of the agreement between the Tutor and the Client, with no refund for any unused Sessions remaining in the Client’s Pack.
  4. 11.4 The Tutor reserves the right to refuse to provide further services to any Client or Student at her sole discretion.

12. Technical Requirements

  1. 12.1 Sessions are delivered via video call. It is the responsibility of the Client to ensure that the Student has access to the following:
    • a reliable internet connection of sufficient bandwidth to support video calling;
    • a device (computer, tablet, or similar) with a working camera, microphone, and speakers or headphones; and
    • a quiet, well-lit environment suitable for focused learning.
  2. 12.2 The Tutor is not liable for Session disruptions caused by the Client’s or the Student’s technical issues, including but not limited to internet connectivity failures, hardware malfunctions, or software problems.
  3. 12.3 If a Session cannot proceed due to the Client’s or the Student’s technical issues and the problem is not resolved within fifteen (15) minutes of the scheduled start time, the Session will be forfeited in accordance with clause 5.2.
  4. 12.4 If a Session cannot proceed due to the Tutor’s technical issues, the Session will be restored to the Client’s Pack at no cost to the Client.

13. Limitation of Liability

  1. 13.1 The Tutor provides tuition to the best of her professional ability and experience. However, the Tutor does not guarantee any particular examination result, grade, university admission outcome, or other academic achievement. Academic outcomes depend on a wide range of factors beyond the Tutor’s control, and the Tutor accepts no liability in respect of such outcomes.
  2. 13.2 Subject to clause 13.4, the Tutor shall not be liable to the Client for any indirect, consequential, or special losses arising from or in connection with the services provided under these Terms, howsoever caused.
  3. 13.3 Subject to clause 13.4, the Tutor’s total aggregate liability under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by the Client for the Sessions or Pack in question.
  4. 13.4 Nothing in these Terms excludes or limits the Tutor’s liability for:
    • death or personal injury caused by negligence;
    • fraud or fraudulent misrepresentation; or
    • any other liability that cannot be excluded or limited by applicable law.

14. Data Protection and Privacy

  1. 14.1 Chemistry Distilled collects and processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  2. 14.2 Personal data collected may include: names of the Client and Student, email addresses, the Student’s educational level, and payment information. Payment card details are processed securely by the Payment Processor (Stripe); Chemistry Distilled does not store or have access to full card details.
  3. 14.3 Personal data is used solely for the purposes of:
    • providing the tutoring services;
    • scheduling Sessions via the Booking System;
    • processing payments via the Payment Processor;
    • communicating with the Client regarding Sessions, account information, and related matters; and
    • complying with applicable legal and regulatory obligations.
  4. 14.4 Personal data is not shared with third parties except as necessary to provide the services, namely: Stripe (payment processing), Calendly (session scheduling), and Amazon Web Services (email delivery). The Tutor will not sell, rent, or otherwise disclose personal data to third parties for marketing or other unrelated purposes.
  5. 14.5 The Client has the right to request access to, correction of, or deletion of their personal data at any time by contacting the Tutor at anna@chemistrydistilled.com.
  6. 14.6 Personal data is retained for the duration of the tutoring relationship and for a reasonable period thereafter for record-keeping, accounting, and legal compliance purposes, unless the Client requests earlier deletion in accordance with clause 14.5.

15. Governing Law and Jurisdiction

  1. 15.1 These Terms and any contract formed pursuant to them are governed by and shall be construed in accordance with the laws of England and Wales.
  2. 15.2 Any dispute arising out of or in connection with these Terms or any contract formed pursuant to them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  3. 15.3 Nothing in this clause 15 shall prevent the Client from exercising any statutory rights available to them as a consumer under applicable law.

16. Dispute Resolution

  1. 16.1 In the event of any dispute or complaint arising from or in connection with these Terms or the services provided, the parties shall first attempt to resolve the matter informally. The Client should contact the Tutor by email at anna@chemistrydistilled.com, setting out the nature of the dispute in reasonable detail.
  2. 16.2 If the dispute cannot be resolved informally within fourteen (14) days of the Client’s initial communication, either party may refer the matter to mediation, to be administered by a mediator mutually agreed upon by the parties.
  3. 16.3 If mediation is not agreed upon or does not resolve the dispute within twenty-eight (28) days of the dispute first arising, either party may commence court proceedings in accordance with clause 15.2.

17. General Provisions

  1. 17.1Entire agreement. These Terms, together with any information provided on the Platform at the time of purchase, constitute the entire agreement between the Tutor and the Client in relation to the services and supersede all prior agreements, representations, and understandings.
  2. 17.2Severability. If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect.
  3. 17.3Waiver. The failure or delay by the Tutor in exercising or enforcing any right, power, or remedy under these Terms shall not operate as a waiver of that right, power, or remedy, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof.
  4. 17.4Amendments. The Tutor reserves the right to amend these Terms at any time. Amended Terms will be posted on the Platform and will take effect from the date of posting. Amendments shall apply to all new purchases made on or after the date the amended Terms are posted. Packs purchased prior to any amendment shall continue to be governed by the Terms in force at the time of purchase.
  5. 17.5Assignment. The Client may not assign, transfer, or sub-contract any of their rights or obligations under these Terms without the prior written consent of the Tutor. The Tutor may assign or transfer her rights and obligations under these Terms to a successor or assignee without the Client’s consent, provided that the Client’s rights under these Terms are not adversely affected.
  6. 17.6Third-party rights. No person other than the Tutor and the Client shall have any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.
